Supreme Court denies DHA Islamabad tax exemption

The Supreme Court has ruled that the Defence Housing Authority (DHA) Islamabad does not qualify as a local authority, rejecting its claim for income tax exemption under Section 49(2) of the Income Tax Ordinance, 2001.

A three-member bench headed by Chief Justice Yahya Afridi and comprising Justice Naeem Akhtar Afghan and Justice Muhammad Shafi Siddiqui dismissed the appeals. ProPakistani reported that Justice Siddiqui authored the judgment.

The court held that an institution must have legal powers to impose taxes or duties and control municipal funds to qualify as a local authority. Simply carrying out development and administrative functions in an area does not amount to local self-government, it ruled.

The ruling said DHA Islamabad failed to establish that it had the fundamental legal characteristics required for local authority status, including the power to impose taxes in its own name or maintain separate funds. The Supreme Court therefore dismissed the appeals and held that the authority was not entitled to an income tax exemption.

The judgment also referred to the Thal Development Authority, which had been recognized as a local authority because it possessed broad statutory powers to impose taxes and maintain its own funds.

Business Recorder reported that DHA Islamabad had claimed the exemption on the premise that it falls within the expression "local authority" under the ordinance. The court rejected that position.

The decision clarifies the threshold for other entities seeking tax exemption as local authorities under the Income Tax Ordinance.
