The Khyber Pakhtunkhwa government has challenged in the Federal Constitutional Court the Peshawar High Court orders that set aside the detention of Pakistan Tehreek-e-Insaf leaders and workers under Section 3 of the Maintenance of Public Order ordinance and stopped their arrest.

The petitions were filed through the provincial chief secretary and have been fixed for hearing. A bench headed by Chief Justice Aminuddin Khan will take them up, Express News reported. UrduPoint also carried the filing, saying the challenge had been lodged and the bench constituted.

Express News reported that the detentions followed the imposition of emergency and governor's rule in the province. The high court had declared the 3 MPO orders null and void in separate cases and directed that those named should not be arrested.

Citing sources, Express News said the petitions concern 51 PTI workers, among them Ehsan, Haq Nawaz Khan, Sadrur Rehman, Fazlullah, Imran Saeed, Muhammad Idrees, Salman, Khan Nawab, Fida Muhammad, Bakht Karam, Izharullah, Amjad Ali, Jamshed Ali, Muhammad Ashfaq, Fazl Jahan, Daud Khan, Saeedur Rehman, Inamullah, Asghar Munir, Adil, Hazrat Ali, Hanif Akhtar, Ghulamullah, Taimur, Naseer, Mubashir Shah, Muhammad Akmal, Ajmal Shah, Hayat Khan, Sajjad, Niaz Muhammad, Abdul Wahab, Gul Badshah, Fazl Karim, Raja Liaqat Zaman, Munir Khan Jadoon, Muhammad Numan, Syed Fahim Shah, Malik Haris, Kashif Khan, Daniyal, Zaiban Khan, Rashid Babar, Dilbar Khan, Muhammad Jahangir and Naveed Shehzad.

The same sources said the provincial government, formed under governor's rule, would also approach the Federal Constitutional Court against Peshawar High Court decisions covering the detention of 150 more PTI workers.

Neither report gave the date fixed for the hearing, and neither said whether the court had issued notices to the workers named in the petitions. The Express News report did not identify the counsel appearing for the provincial government or for the detained workers.

The Federal Constitutional Court is hearing a growing set of cases from Khyber Pakhtunkhwa arising from the emergency and governor's rule, with the provincial administration using the chief secretary's office to contest high court relief granted to PTI leaders and workers held under the public order law.

UrduPoint's report carried no details beyond the filing and the composition of the bench.
